Welcome to RubyFit.com.au. Please read these terms and conditions carefully before ordering any product from this site. If you continue to browse and order anything from the website, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy and security policy govern our relationship with you in relation to this website. If you disagree with any part of these terms and conditions, please do not use our website. You should print a copy of these terms and conditions for future reference.

The use of this website is subject to the following terms of use:

  • The content of the pages of this website is for your general information and use only. It is subject to change without notice.
  • Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
  • Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific requirements.
  • This website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.

  • From time to time, this website may also include links to other websites. These links are provided for your convenience to provide further information. They do not signify that we endorse the website(s). We have no responsibility for the content of the linked website(s).
  • Your use of this website and any dispute arising out of such use of the website is subject to the laws of Australia.

Currency

  • The currency used for all transactions on the website are in Australian Dollars (AUD$) and the prices displayed are inclusive of GST (if applicable).

Orders and Payments

  • To place an order with RubyFit you must have a valid credit card or debit card issued by an acceptable bank.
  • You must pay in full for the product at the time of ordering by supplying your credit or debit card (which is acceptable to us) or by Paypal. Alternatively you can pay by any method which we have said is acceptable to us. In either and all cases, we are not bound to supply the order until we have received the cleared funds in full.
  • When you place an order with us, you agree to the terms and conditions current at the date you submit your order.
  • We have the discretion to refuse to accept an order from you for any reason, including unavailability of supplies. We may offer you an alternative.
  • If you discover that you have made a mistake with your order after you have submitted the order on the website, please contact us on service@rubyfit.com.au immediately. We do not guarantee that we will be able to amend your order.
  • We may cancel a contract if the product is not available for any reason. We will notify you if this is the case and return any payment which you have made.

Delivery of Products

  • We aim to deliver the product with you as requested per your order.  We use the services of Australia Post to deliver Australia-wide and we are bound to their service standard for delivery of parcels.
  • We and none of our third parties (eg Australia-post) will not be liable to you for any losses, liabilities, costs, damages or charges due to delivery or late delivery of your item.
  • If delivery is delayed through your unreasonable refusal to accept the delivery (within 2 weeks of our attempt to deliver the product to you), then we are able to do the following
    • Charge you a storage fee for the parcel if incurred by us
    • No longer make the product available for delivery and will cancel the contract, where we will refund you the money already paid to us, minus our administration charges (which may include the delivery fee and any additional fees incurred)

Acceptance of Goods

  • On receiving the order the customer is responsible for inspecting the goods for any fault or damage.
  • If there is a fault on the product, it is the customer’s responsibility to notify RubyFit as soon as possible. For more information, please see the Returns Policy.

Promotions and Vouchers

  • You may use promotional voucher and gift vouchers as payments for certain products on the site, according to the terms specified in the voucher. They cannot be used in conjunction with other offers.
  • Individual brands may be excluded from voucher promotions.
  • No refund will occur (for any reason) on a promotional credit.
  • Only one promotional voucher can be used per order.
  • Gift Vouchers expire 365 days after date of purchase and cannot be redeemed for cash. 
  • Gift Vouchers are currently electronically sent. If you would like your voucher sent to you, an extra charge of $10.00 is required (to cover shipping costs). 

Returns Policy

  • All returns must be made within 30 days of date of purchase for a full refund of total amount paid.
  • To be eligible for a full refund, the item must be returned to us in original condition and packaging, unworn and undamaged.
  • Customers must also be able to show proof of purchase including invoice number, name and date of purchase
  • Customers are responsible for the return shipment and associated costs of returning an item.
  • RubyFit will not responsbile any items lost in transit. This risk and any losses are borne of the customer. 
  • RubyFit is indemnified from any losses or costs which arise from the return of items
  • RubyFit recommends sending all items that need to be returned via registered post to minimise the risk of lost items

Competitions and Giveaways

  • RubyFit may offer free monthly giveaways and prizes at our discretion.
  • To be eligible to win the competition, you have to be an active member of our newsletter subscription.
  • Competition entrants are only eligible if they are over 18 years of age and are residents in Australia
  • No international entries are eligible to win.
  • As the monthly winner of the competition, you will allow us to announce your name and suburb within our website and social media channels.
  • The monthly winner of the competition will be notified on the first business day of the following month, by email only.
  • The winner has 3 working days to respond to RubyFit to provide a valid Australian address for us to send the prize and advise of their sizing requirements.
  • If the requested size of the item is unavailable for whatever reason, the winner will be unable to claim the prize for that month. 
  • Competition winners are not entitled to free shipping and will be charged $9.95 for their item to be delivered (Australia-wide). Shipping cost has to be paid for in advance before the item is shipped out. 
  • The competition or giveway may be stopped by RubyFit at any given time, without any warning, notice or reason

RubyFit Loyalty Program (if valid)

  • The loyalty program is only available to RubyFit members that are logged in
  • Loyalty points cannot be backdated or given for previous orders for a time when the person was not a RubyFit member
  • The loyalty program only applies to online purchases
  • The loyalty program may be stopped and cancelled at any time
  • The points earnt from the loyalty program cannot be redeem for cash for any reason or exception
  • RubyFit is not responsible for any loss of income or damages arising as a result of the loyalty program
  • It is at RubyFit’s discretion as to whether other discounts or vouchers can be used in conjunction with the discounts provided by the loyalty program.
